The Supreme Court delivered a landmark judgment regarding leaders with a criminal background and said that they stand to be disqualified on date of conviction. The number of members of Parliament with a criminal background is 162, which means 30 per cent of those who govern the nation in the Lok Sabha have pending criminal cases.
Observing that the trial court conducted proceedings with a "predetermined notion of conviction", a division bench of Justices AS Supehia and Vimal K Vyas quashed the CBI court's order sentencing Solanki and the six others to life imprisonment.
The judiciary, the police, the lawyers and the public will have to know the new laws. It will also endanger settled jurisprudence on the old laws and open up all sorts of minor and major problems that currently do not exist. Whose then was asking for the change?
